Truecone Terms of Service
These Terms explain the rules for using Truecone and how disputes are handled.
Short version: use Truecone as a studio recordkeeping tool, not as safety advice. You keep responsibility for kiln operation, your records, exports, backups, and purchases made through the App Store.
Acceptance
By using Truecone, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.
In these Terms, "we," "us," and "our" refer to Truecone.
Using Truecone
License to use the app
We give you a personal, non-transferable license to use Truecone on Apple devices you own or control, subject to these Terms and Apple's rules for apps obtained through the App Store.
Your records
Your studio records, photos, notes, imports, and exports are yours. You are responsible for checking that records are accurate, keeping copies you need, and deciding what to share outside the app.
You give Truecone permission to process your records only as needed to provide app features you choose, such as local storage, search, charts, exports, imports, reminders, and iCloud backup.
Studio and kiln responsibility
Truecone is a logbook and workflow tool. It does not replace kiln manuals, manufacturer guidance, professional judgment, safety practices, ventilation requirements, electrical work, maintenance inspections, or emergency procedures.
You are responsible for kiln operation, firing decisions, maintenance, workplace safety, and the results of any firing. Truecone does not guarantee firing outcomes or prevent damage, loss, injury, or downtime.
Acceptable use
Do not misuse Truecone, interfere with app services, attempt unauthorized access to systems, send unlawful or harmful feedback content, or use the app in a way that violates law or another person's rights.
Purchases, Backups, and Exports
Studio Pass and App Store purchases
Paid features are handled through the App Store. Apple processes payment, taxes, refunds, family sharing where available, and purchase records. Truecone unlocks features when the App Store reports an active entitlement.
Backups and exports
Manual backup export and import may be available without Studio Pass. Automatic iCloud backup and richer export formats may require Studio Pass. iCloud backup depends on your Apple account, iCloud availability, network access, and storage limits. Exported files are your responsibility once you save or share them. Keep your own backup copies of important studio records.
Changes, updates, and availability
We may update, add, change, or remove features. We may stop providing the app or a feature if needed for security, legal, App Store, operational, or business reasons. We will try to avoid unnecessary disruption to local records.
Disclaimers and Limits
Disclaimers
To the fullest extent allowed by law, Truecone is provided "as is" and "as available." We disclaim warranties that the app will be uninterrupted, error-free, or fit for a particular studio, kiln, firing schedule, material, or business use.
Some laws do not allow certain warranty limits. Those limits apply only to the extent the law allows.
Limits on liability
To the fullest extent allowed by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost work, damaged materials, damaged ware, kiln damage, business interruption, or substitute services.
To the fullest extent allowed by law, our total liability for claims related to Truecone is limited to the amount you paid for Truecone or Studio Pass in the 12 months before the claim, or 100 US dollars if you paid nothing. This does not limit liability that cannot be limited by law.
Massachusetts Law
Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Where the law allows, claims related to Truecone must be brought in the state or federal courts located in Massachusetts.
This section does not take away consumer rights or court options that cannot be waived by contract.
No arbitration clause
These Terms do not require arbitration. They do not include a class action waiver or jury trial waiver.
Informal resolution
If you have a dispute, please contact us first and give us a reasonable chance to resolve it. This informal step does not prevent either side from using rights or procedures that apply under Massachusetts or other applicable law.
Ending Use
You may stop using Truecone at any time. You can export records before deleting the app if you want to keep a copy outside the app.
If the Privacy Policy or these Terms change, Truecone asks you to review and accept the updated documents before continuing.
